All residents of Russia are required to pay utility bills, fines, and other debt obligations in a timely manner. The presence of debt will not allow a citizen to travel abroad, since data on unpaid bills are contained in the database of the customs service.

The law on the prohibition of travel abroad in 2020 defines the grounds for refusing to cross the state border of Russia.

The grounds for prohibiting travel abroad are contained in Federal Law 114 “On the Procedure for Departure from the Russian Federation and Entry into the Russian Federation”. The legal document was developed and approved by the deputies of the State Duma in 1996. A month after its adoption, it entered into force. The last changes to the official text of the bill were made in 2017.

According to the provisions of the current act, the decision, certified by the signature of the bailiff, is the basis for not releasing a citizen from Russia. The legislation provides for the following grounds for imposing restrictions:

  • for at least 5 years, persons working with sensitive information and state secrets must not travel abroad. Usually these conditions are written in the employee's contract. This period may be longer;
  • it is forbidden to leave the territory of Russia for citizens who are in military or alternative civilian service on conscription. The restriction is valid until the end of the service;
  • persons subject to legal proceedings may not travel abroad until the process is completed;
  • citizens convicted of a crime or serving a prison term cannot travel abroad;
  • when imposing an administrative penalty and evading its execution, it is forbidden to leave the country;
  • if incorrect information is deliberately provided to the passport office, you cannot travel abroad;
  • in case of bankruptcy of a businessman, restrictions are imposed.

Current legislation provides for the sending of a written notice to persons who are prohibited from traveling abroad. The notice shall indicate the terms and reasons for the imposition of restrictions. When issuing a ban, a citizen's international passport is transferred to the passport office, where it is kept until the prescribed period has expired.

As for military personnel, they can only go abroad if they have permission from the highest authorities, registered in accordance with the provisions of the law. Certain restrictions are provided for residents under the age of 18. They may leave Russia only if accompanied by one of the following persons:

  • one of the parents;
  • guardian;
  • adoptive parent;
  • trustee.

If a minor is forced to go abroad on his own, it is required to provide a notarized consent of the parents or guardians. Guardianship authorities should receive information about all movements of persons under 18 years of age.

Information about all persons in respect of whom the regulatory authorities have issued a decision to ban travel abroad is contained in the database of border guards. Restrictions are imposed on a resident of the country in the following cases:

  • there are debts on taxes and fines;
  • overdue alimony;
  • delayed payment of utilities;
  • loans that are not paid on time.

If a person has debts to pay for housing and communal services, this does not necessarily mean that he will not be released from Russia. To impose restrictions, the amount of debt must exceed 10 thousand rubles. If it is less, the authorities do not have the right to impose a ban on the movement of a citizen.

When a person receives a notification about the restrictions imposed on him, he can pay the existing debt within 14 days. After this period, information about the ban is transmitted to the border guards.

Restrictions are not removed immediately, but within 10 days after the transfer of the amount of overdue payments. This period can be shortened if the citizen submits a medical certificate confirming that the trip is for medical reasons. If the ban is imposed due to the existence of a debt for utilities, it will not be enough to present a receipt at the border for their payment. Restrictions are removed only by authorized bodies.

Late Payment Penalties

All residents of the country who are in arrears on certain payments are included in the "black list" of all points that carry out border crossings. Therefore, the debtor will not be able to leave the country until he pays off the existing debts.

In addition, the law provides for another measure of influence on non-payers. If there is a debt on housing and communal payments, a citizen is obliged to pay 17.7% of the total amount annually to the budget.

How to find out if there is a ban on traveling abroad

The legislative document establishes that the bailiffs must necessarily notify the resident of the imposition in relation to his ban. The message is sent to the address at which the person is registered. You can check for the restriction yourself.

This service is provided on the official website of the bailiff service. In addition, information is available on the websites of the following organizations:

  • the public services portal provides information on tax arrears, fines and outstanding payments on court decisions;
  • the website of the tax service contains data on debts, access to which requires a taxpayer identification number;

How to lift a travel ban

Today, the ban on leaving the territory of Russia is one of the most effective measures to combat debts.

A citizen will not be able to go abroad if administrative proceedings have been initiated against him, which is associated with the presence of various types of debts. Those who do not pay their obligations on time are also included in the “black list”.

In order to be able to travel abroad again, a person will first need to pay off the existing debt. Bills must be paid in the organization that filed a claim.

After the official department makes a decision to impose restrictions, the citizen will have 2 weeks to pay all debts. It should be remembered that this period is calculated from the moment the decision was made, and not from the day the person received it.

Bailiffs have the power to set aside a decision. They remove the restrictions when the debtor submits a document on the repayment of all overdue payments. The procedure takes place in several stages:

  • existing debts are paid off;
  • funds are transferred to public utilities (or other organizations), which is reported to the bailiffs;
  • a department specialist draws up a resolution and sends it to the border service;
  • the data obtained allow us to lift the ban on leaving.

In some cases, the decision to ban can be challenged. The law provides for a similar procedure if the decision was drawn up with errors. This can happen when the bailiff wrote out the grounds for the ban, but within the same period the debtor had already paid off the overdue payments. The presence of debt does not mean the presence of restrictions on travel

As you can see from user posts on our Forum and other resources, people very often confuse debt with a limit. Of course, there are no restrictions on leaving without debts (with the exception of prohibitions not on debt issues), while the very presence of debt does not mean the existence of restrictions. Even if you have a valid enforcement proceeding and you see it on the website of the Russian Federation, this does not mean that a travel ban has been imposed on you.

How to check debts and travel restrictions?

In this article, I will not consider in detail how to check debts, this is described in detail in the online services section. If you briefly describe this issue, then you can check the debts on the State Services website (if you do not have an account yet, you can read the detailed instructions on how to register an account on the State Services), I also advise you to look at the presence or absence of enforcement proceedings (IP) on the site. As I wrote above, there is no online service for checking travel restrictions!!! Remember, there are various sites on the network where you can be offered to check the restrictions for money, as a rule, these are just scammers who will receive your money and will not help you in any way. And of course, in the mountains of rubbish in the search results of the Runet, there are a lot of articles in which the concepts of “Debt” and “Restriction” are confused. All you can check is the presence of debts and IP.

Grounds for restriction on travel abroad

Restrictions on travel abroad are imposed only on the following grounds:

  • There is enforcement proceedings, based on a court decision and a writ of execution, or the court decision itself, indicating the obligations imposed on the citizen;
  • The court decision must enter into force (is not in the process of appeal and not be appealed);
  • The writ of execution must be valid and presented in accordance with the law, within 3 years from the date of entry into force;
  • The amount of debt in enforcement proceedings is more than 10,000 rubles, with the exception of certain categories of debts, where, in accordance with the new law, which entered into force on October 1, the amount of debt must exceed 30,000 rubles;
  • The debtor evades the fulfillment of the requirement to make payment on time without a good reason.

In the absence of at least one of the above conditions, the legality of the restriction on travel abroad can be challenged.

Important: Alimony debtors, citizens who owe compensation for harm caused to health or due to the death of a family breadwinner, as well as in connection with property damage or moral damage, as before the adoption of new amendments, may be restricted from traveling abroad if the amount of debt is 10,000 rubles.

A limitation for a period of 6 months can be established both at the initiative of the bailiff and at the request of the recoverer, provided that the debtor has not voluntarily fulfilled the requirements for paying the debt within 2 months. When imposing a ban, the bailiff - executor required to send notice of travel restrictions, to the address of permanent registration of the debtor, or to the known address of his residence.

Important: The period of 6 months for which the travel restriction is issued is considered from the date when it was issued by the bailiff (and not when this decision reaches the border guards).

Traveling abroad with debts without breaking the law!?

Consider the option when the bailiff handed over the decision and you signed for receipt, everything seems to be according to the law, but you have to go, and you have tickets on hand. Here we come to the main question. How to go abroad if there is already a travel restriction and it is not possible to return debts to bailiffs? Of course, it would still be right to pay off the debt and fly calmly, although in this case you still have to wait, as I wrote above, the receipt of payment and the cancellation of restrictions takes about 2 weeks!

It is important that a person becomes restricted to travel abroad by no means at the moment the debt arises, and not even always after a court decision has been made. The decision to restrict travel is made either by the court (if we are talking about alimony arrears), or by the FSSP - in other cases. The general scheme looks like this: first, the debt is transferred to the court, which makes a decision on enforcement, after which the debt is sent to the bailiff service, which collects. The exception is the debt on traffic police fines - they are immediately transferred to the FSSP, bypassing the courts.

In practice, bailiffs do not often resort to a travel ban, says Mikhail Kyurdzhev, partner at the A2 Law Office. “It is much easier to send a request to the bank, and if the debtor has funds on the card, they are immediately debited to the budget,” the lawyer explains. In addition, bailiffs can "freeze" money on the card. Then the debtor will have to pay the debt and provide the FSSP with a receipt for payment. After that, within seven days, the funds on the card will be unlocked, says Kyurdzhev.

How soon can you become banned

A creditor (whether an individual or a legal entity) has the right to go to court as soon as a delay occurs, says Svetlana Tarnopolskaya, partner at the Yukov & Partners Bar Association.

60 days are given to pay administrative fines, including traffic police fines, after which the debt, bypassing the court, is transferred to the FSSP. However, the service itself does not make a decision to ban travel for such debts; for this, the bailiffs must go to court, which assesses the need to establish a ban.

The deadline for paying taxes is set by the Tax Code and depends on the type of tax, Kurdzhev says. “If taxes are not paid on time, then the resulting debt may not be referred to the court for a very long time - as practice shows, up to several years,” he says. Much depends on the amount of tax debt. According to Pavel Khlyustov, a partner at Barshchevsky and Partners, the amount of debt matters to tax authorities: they go to court if the volume of tax claims exceeds 10 thousand rubles.

The trial itself - from the moment of application to the entry into force of the court decision on recovery - can take several months. After the court makes a decision on enforcement, this debt passes to the bailiff service. The plaintiff must independently apply to the bailiffs with a statement to initiate enforcement proceedings, says Tarnopolskaya.

Simultaneously with the submission of the application, the creditor has the right to write a petition to restrict the debtor from traveling abroad, says Pavel Khlyustov. Also, according to the law on enforcement proceedings, the bailiff can issue a decision on a temporary restriction on departure on his own initiative.

After receiving the writ of execution, the bailiff is obliged to initiate proceedings and send the decision to the debtor, Khlyustov said. “The deadline for the execution of the decision is five days from the date of receipt of the notice from the FSSP. If the recipient does not pay the debt during this period, then he may be restricted from leaving, ”says the lawyer. The travel ban is typically set for six months, but can be extended if the debt is not paid within that period, Safiulin adds.

How to find out about the ban

Lawyers interviewed by RBC recommend checking the FSSP database at least once every few months for unpaid debts. This can be done remotely - for example, using the "Data Bank of Enforcement Proceedings" service on the service website or through the FSSP mobile application. In addition, the service's applications are available on the social networks VKontakte and Odnoklassniki. You can also get information about enforcement proceedings through the public services service. In addition, debtors can call or come to the FSPP branch.

At the same time, the debtor will not be able to find out about the restriction on traveling abroad for these debts on the FSSP website, says Safiulin. According to him, you need to ask the bailiff who is handling the case about the possibility of going abroad. Or if the debtor has a personal account on the public services website, then he can receive an electronic notification from the FSSP there, the expert adds.

However, lawyers note that incorrect information periodically appears in the FSSP - for example, about already paid fines or incorrectly assessed taxes. However, such cases are usually caused by technical errors and occur relatively rarely, says Pavel Khlyustov.

What should debtors do?

The FSSP recommends checking debts at least five days before travel, and lawyers interviewed two weeks before. You can pay the debt on the FSSP website - transfer money from a bank card or from a mobile phone account, as well as through the WebMoney system. You can also pay at the bank, having previously received a receipt and details on the website or at the reception at the bailiff.

Having paid off the debt, it is necessary to provide supporting documents to the bailiff, who will have to sign the decision to lift the travel ban and send it to the border guards, says Marat Safiulin. According to the law on enforcement proceedings, this procedure can take from 10 to 14 days. Pavel Khlyustov advises debtors to control the entire process, from time to time reminding the bailiffs about himself.

If the debt appeared in the FSSP database by mistake, then first you should talk to the bailiff, says Kyurdzhev. “If the database reflects an already paid fine, ask the bailiff for an e-mail and send copies of payment documents there,” he says. If the problem is not resolved, the debt can be challenged in court. “The process of restoring justice, as a rule, stretches for months. Therefore, if the "debt" is not very large, many people prefer to pay it off, go abroad, and only then dispute it. However, this is the wrong strategy,” Safiulin warns.

According to him, if a person pays the "debt" and then goes to court, the court will most likely regard the fact of payment as recognition of the debt. In this case, the chances of returning the money already paid are extremely small. So it is necessary to protest the debt as soon as a person finds out about it. At the same time, the "debtor" will remain on the list of people not allowed to travel abroad until the end of the proceedings, the expert admits. “But in this case, he has the opportunity to try through the courts to recover the damages incurred in connection with the unlawful imposition of a travel ban,” he concludes.

At the same time, the opinion that it is erroneous to lift the travel ban by paying off debts, if any, directly at the airport. “Citizens can pay off the debt right at the airport right now, however, the temporary restriction on leaving the Russian Federation will not be immediately lifted,” the press service of the FSSP said. The fact is that information about the retribution must reach the bailiffs, and this takes time.

So far, the only thing that is supposed to be done is to shorten this period. “A draft law has already been submitted to the State Duma, according to which the bailiff under the director of the Federal Bailiff Service of Russia will lift the restriction on leaving the Russian Federation as soon as information on the repayment of the debt is reflected in the State Information System on State and Municipal Payments (GIS GMP). This will significantly reduce the time for lifting the temporary restriction on leaving the Russian Federation,” the press service of the FSSP points out.

There is a misconception that if there is a debt on a loan, then the exit from Russia is closed. But delays in and of themselves do not mean that it will be impossible to go abroad. When exactly does an outstanding loan become a reason for a ban on traveling abroad? And what to do if you are refused to cross the Russian border?

Is it possible to go abroad if there is a loan

The answer is unequivocal - yes. The presence of one or even several executed loan agreements in no way imposes restrictions on traveling abroad.

If you have loans, you can go abroad both on vacation and for permanent residence. Moreover, they are released abroad without any problems even if there is a loan debt.

If there are delays, the security service of the bank or that they will be restricted from leaving Russia. But in most cases, this is just intimidation - certain circumstances must occur for the travel ban to take effect.

When they may not be allowed to go abroad due to a loan

The main thing to understand is that only a court can limit the possibility of a citizen leaving the territory of another state. Neither the bank, nor collectors, nor even the bailiffs themselves have such powers.

According to Law No. 114 “On the procedure for leaving the Russian Federation ...”, in order to limit the ability to leave the territory of the country, the bailiff must apply to the court with such a request. If the arguments presented are convincing, then an appropriate decision will be made. And only after its entry into force, a citizen will not be able to leave Russia.

Important! It is possible to impose travel restrictions only if the debt exceeds 10 thousand rubles. Now amendments to the law are being considered - it is proposed to increase this figure to 30 thousand rubles. But the final decision has not yet been made.

The basis for going to court can only be the debtor's failure to comply with an earlier decision on the forced collection of funds in favor of the bank. In other words, enforcement proceedings should already be opened against him.

Example

Ivan is at VTB Bank, but after six months he stopped making payments. After unsuccessful attempts to resolve the issue amicably, the creditor went to court. Based on the results of the consideration of the case, the decision was made in favor of VTB - to recover 450 thousand rubles from Ivan. But the debtor refused to voluntarily execute the order. To influence Ivan, the bailiff decided to go to court with a request to restrict the borrower from leaving Russia.

That is, if you have overdue obligations, but the case has not reached trial and a decision, then you cannot be banned from traveling abroad due to an unpaid loan.

How to find out if they will let you through the border

In order not to find out about restrictions on leaving Russia at customs, check this information in advance. It is recommended to do this not only if there is a loan - sometimes mistakes happen and incorrect information gets into the database.

The surest way to find out about the presence of restrictions on crossing the border is to look for yourself in the database of enforcement proceedings. For this you need:

  • go to the official website of the Bailiff Service;
  • click on the "Services" section;
  • go to the "Data Bank of Enforcement Proceedings".

Important! The presence of open enforcement proceedings does not mean that the ban on traveling abroad is already in effect. It depends on whether the bailiff applied to the court for the imposition of such a restriction.

If you see on the site an enforcement proceeding opened against you by a court decision that you really do not execute, then contact the bailiff at the place of your registration for accurate information.

What to do to fly out of Russia if there is a restriction

If it turns out that a ban on traveling abroad has already been imposed, then leaving the country will not work. By law, the restriction is removed either by agreement of the parties, or in the case of full fulfillment of overdue obligations. In practice, it is almost impossible to implement the option of reaching an agreement with the creditor - since the case has already gone to court, it means that the possibility of a peaceful settlement could not be used.

Important! Information in the database of bailiffs is updated within 14 days. If you are going on vacation, a business trip, or even want to go abroad to live, then it is necessary to resolve the issue of lifting the restriction in advance.

If the travel ban due to loan debts is imposed by mistake, then you need to contact the bailiff service personally. Usually this is enough to correct the information in the database, after 2 weeks the data will be displayed correctly.

In cases where the debtor really does not comply with the instructions of the court decision and does not pay off the debts on the loan, the restrictions can be removed only after the obligations have been fulfilled.

You can notify the bailiff of the fact of payment of the debt in several ways:

  • without a visit - you can send the original (or a certified copy) of the receipt or payment order via Russian Post, fax or e-mail;
  • personally - you should approach your bailiff during the reception hours with the original documents confirming the repayment of the debt.

If the trip is planned in the near future, then the best option is to go to the bailiff yourself. So you can be sure that the document is accepted for work. This means that travel restrictions will be lifted in due time.

What to do if there is no money to pay off the debt

When the court decides to collect the debt in favor of the bank, the bailiff has the right:

  • seize the borrower's property for subsequent sale in favor of the creditor;
  • write off money from the accounts of the debtor;
  • apply to the employer for forced deduction of money from the salary.

But if the debtor does not have a job, property and money, then there will be nothing to repay the debt. In this case, money for settlements with the creditor to remove the restriction on traveling abroad can only be re-borrowed.

Unfortunately, banks almost never approve new loans to debtors - a negative credit history plays a significant role. But there are a few tips that you can use to increase the likelihood of getting the right amount:

  • provide proof of your positive financial position;
